Terms of Service

1. Acceptance of Terms

By creating an account or using TraderPulse (“the Platform”), you accept these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Platform.

2. Service Description

TraderPulse is a SaaS platform for traders that provides a trading journal, analytics, risk management, psychological tools, broker integrations, and tax reports. The Platform is provided “as is” and “as available”.

3. ⚠️ Critical Financial Disclaimer

TraderPulse is NOT investment advice.

  • We are not a broker-dealer, registered financial advisor, or investment advisor.
  • The tools, metrics, alerts, and suggestions provided by TraderPulse are informational and do not constitute a recommendation to buy, sell, or hold any financial instrument.
  • Trading futures, stocks, options, and other instruments involves substantial risk of loss, including the possibility of losing more than the capital invested.
  • Past results do not guarantee future results. Simulations (Monte Carlo, backtesting) are hypothetical.
  • You are solely responsible for your trading decisions. Consult a licensed financial advisor before trading.
  • TraderPulse does not control broker platforms or prop firms. Compliance with rules (FTMO, TopStep, Apex, etc.) is the user's responsibility.

4. Account and Eligibility

  • You must be at least 18 years old.
  • You are responsible for keeping your password confidential.
  • Notify us immediately if you suspect unauthorized access.
  • One person may have only one personal account. Team accounts (Team plan) allow multiple users under a single subscription.

5. Subscriptions and Payments

  • TraderPulse offers Free, Pro, and Elite plans (prices visible at /pricing).
  • Payments are processed through Stripe. We accept major credit and debit cards.
  • Subscriptions renew automatically at the end of each period (monthly or annual) unless you cancel.
  • You can cancel at any time from Settings → Billing. Cancellation takes effect at the end of the current period.
  • Refunds: see Refund Policy (14 days).
  • Prices in USD. Stripe may apply currency conversion. Stripe Tax will apply taxes according to your jurisdiction.

6. Acceptable Use

You may not:

  • Use the Platform for illegal or fraudulent activities.
  • Perform reverse engineering, mass scraping, or attempt to compromise security.
  • Share your account with third parties (Free/Pro/Elite accounts are personal).
  • Upload malicious, infringing, offensive content or content that violates third-party rights.
  • Use the Platform to distribute trading signals, spam, or unauthorized automation.
  • Overload our infrastructure with abnormal usage (rate limits apply).

Violations may result in suspension or termination of your account without a refund.

7. Intellectual Property

  • The code, design, branding, and content of TraderPulse are our property.
  • Your data (trades, journal, screenshots, etc.) belong to you. We grant you a license to use them within the Platform.
  • You grant us a limited license to process your data for the sole purpose of providing the service.
  • Community/Public posts: by publishing public content, you grant TraderPulse and other users the right to view and comment on it.

8. Third-Party Integrations

If you connect external services (Anthropic Claude, brokers, TradingView, Discord, Stripe, etc.), your use is subject to their respective terms. TraderPulse is not responsible for failures, API changes, or consequences of those services. The API keys you provide are your responsibility.

9. Availability and Support

  • We aim for 99% uptime but do not guarantee uninterrupted availability.
  • Scheduled maintenance will be announced when possible.
  • Support is provided via email (legal@veldevpr.com) with a response time of up to 48 business hours (24h for Elite).

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADERPULSE IS NOT LIABLE FOR:

  • Trading losses arising from the use (or non-use) of the Platform.
  • Loss of accounts with prop firms.
  • Indirect, incidental, special, or consequential damages.
  • Loss of data due to technical failures (we do maintain backups, but we recommend exporting JSON regularly).
  • Errors in tax calculations (Form 8949 is informational; consult a CPA).
  • Availability or changes in third-party APIs.

Our total aggregate liability to you, for any cause, shall not exceed the amount you paid in the 12 months prior to the event giving rise to the claim.

11. Indemnification

You agree to indemnify TraderPulse from any claim arising from your use of the Platform, violation of these Terms, or violation of third-party rights.

12. Termination

You may close your account at any time. We may suspend or close your account if you violate these Terms, without a refund.

13. Changes to the Terms

We may modify these Terms. Material changes will be notified by email with 30 days' advance notice. If you continue using the Platform after the effective date, you accept the new Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Puerto Rico, United States. Any dispute will be resolved in the competent courts of San Juan, Puerto Rico, unless applicable law provides otherwise.
